NOTICE PROVISIONS

If you do not agree with this agreement or any of its terms during the reading process, you should immediately stop the registration process.

[Confirmation and Acceptance of the Service Agreement]

The DidaTravel Platform is operated by Shenzhen DidaTravel Technology Co., Ltd. Specific travel services or products (hereinafter referred to as "products/services") are provided by qualified service providers. The DidaTravel Platform provides a booking platform through its website and mini-programs. If you access, book, or use products/services on this website or other mobile applications or software providing DidaTravel booking services (hereinafter referred to as the "DidaTravel Platform"or "we"), it is deemed that you have accepted the "DidaTravel Platform Service Agreement" (hereinafter referred to as "this Agreement"). Before confirming your registration as a DidaTravel Platform user (hereinafter referred to as "client" or "user"), please carefully read and fully understand the relevant terms of the contract, especially the bolded sections below. If you do not agree with any of the following content, please immediately stop accessing the DidaTravel Platform or using any products/services provided by the DidaTravel Platform .

I. General Provisions

This agreement includes the main text of the agreement, individual service agreements for the sub-channels of the DidaTravel Platform , and other rules that have been or may be published by the DidaTravel Platform , including but not limited to disclaimers, personal information protection policies, Cookies Agreements, personal information authorization statements, product booking terms/booking notices, and other agreements ("Other Terms"). If there is any inconsistency between this agreement and the "Other Terms," the "Other Terms" shall prevail. Unless otherwise explicitly stated, any products/services provided by the DidaTravel are subject to this agreement.

In this agreement, " DidaTravel" refers to the developer and operator of the DidaTravel Website,Shenzhen DidaTravel Technology Co.,Ltd. . "Affiliated Companies" refer to all companies under Shenzhen DidaTravel Technology Co., Ltd. and its subsidiaries and affiliated companies, including but not limited to Shenzhen GoodluckTrip International Travel Service Co.,Ltd. ,Shenzhen Youdao Limited. ,Caring(Shenzhen) Travel Service Co.,Ltd. , and Zhejiang GoodluckTrip International Travel Service Co.,Ltd., hereinafter referred to individually or collectively as "DidaTravel" or "we."

In this Agreement, "DidaTravel Platform" means the web pages and clients (including wechat mini programs or H5 pages) whose domain names are [dida.com], and the terminal devices applicable to the client include but are not limited to PC, tablet computer, mobile phone, etc.

In this Agreement, "User" or "Client" means a natural person or legal entity who accesses or uses the products/services provided by the DidaTravel Platform. After successful registration, you need to complete the enterprise certification of the DidaTravel Platform as soon as possible to prove that you have obtained the full authorization of the enterprise filled in when registration.If you log in to the as a client of DidaTravel Platform, access the DidaTravel Platform , or use DidaTravel services, it is deemed that you agree to all the terms of this agreement and other rules, explanations, and operational guidelines published by DidaTravel. This agreement is jointly concluded by you (or simply referred to as "customer" or "user") and Shenzhen DidaTravel Technology Co., Ltd. (collectively referred to as "DidaTravel ") based on the principle of mutual benefit.

II. Service Scope and Website Information

The DidaTravel Platform provides you with a platform through its website and mini-programs, where you can browse different types of travel products, including but not limited to hotels (including guesthouses, serviced apartments, inns, and homestays), air tickets, etc. By booking through the website, you agree to book the travel products at the listed prices and abide by other conditions stipulated by the website. If the DidaTravel Platform system accepts the booking and displays a booking success prompt, a contract binding on both parties is formed, and it also means that the travel product supplier has confirmed your booking. If we accept your travel product booking or if the booking is unsuccessful, we reserve the right to refuse the booking as described below.

We publish information about travel products based on the information provided to us by suppliers [including but not limited to suppliers and their representatives, distributors, destination management companies (DMCs), channel managers, partners, etc.]. Shenzhen GoodluckTrip International Travel Service Co.,Ltd. and Shenzhen Youdao Limited. provide booking accommodation services to users through the DidaTravel Platform, and the accommodation services are provided by accommodation service providers (hotels.). Other travel products/services are provided by other affiliated companies. We will make reasonable efforts to manage the services provided, but we cannot guarantee the accuracy, completeness, authenticity, and timeliness of the information, nor will we be responsible for errors (including obvious and typographical errors), interruptions [whether due to website (temporary and/or partial) failures, repairs, upgrades, maintenance, or other reasons], inaccuracies, misleading or false information, or unpublished information. Sudden changes in market conditions or the environment may result in the information published on the website being inaccurate or outdated. If problems arise, our customer service will provide reasonable assistance and act as an intermediary between you and the travel product supplier.

The listing of travel product supplier names on this website does not mean or should be construed as a recommendation of the travel product supplier or an endorsement of the travel product supplier (service quality, level, or rating). We hereby declare that we do not represent, guarantee, or promise the quality, condition, or suitability of the travel product suppliers listed on the website. We reserve the right to refuse or accept customer bookings (or cancel confirmed bookings under special circumstances) for any reason without the need to prove it. Common reasons for refusing client bookings include but are not limited to: travel product supplier requirements, client violation of service terms, trade or economic sanctions, bans, legal restrictions, (suspected) fraud or theft, criminal suspects, suspicious bookings, client submitting misleading or false information, misconduct, threats, insults, refusal to provide information, actual obstacles, communication problems, obvious errors (as defined below), improper customer history, inclusion in government or international organization (US, EU, UN, Singapore...) blacklists, etc. If the DidaTravel Platform system refuses or cancels a booking and you have already paid the fee, we will refund all booking fees to you. We also reserve the right to refuse users temporary or permanent access to the DidaTravel Platform system at our discretion.

We occasionally cancel or refuse bookings on the grounds of "obvious errors," regardless of the cause of the error. For clarity, an obvious error refers to an error that a reasonable person would not expect to appear on the website (e.g., regarding price). In such cases, we will refund the fees received to the client. DidaTravel Platform has full discretion to decide whether to cancel or refuse a booking for this reason.

Please note that we may refuse suspicious group bookings, as most travel product suppliers have special procedures for group bookings. For more information, please contact our client service team.

Ongoing renovations, travel product booking errors, and individual customer needs may affect the quality of your stay or travel. Please ensure that you inform the travel product supplier directly of your specific needs and requirements during check-in or travel.

III. Star Ratings of Travel Product Suppliers

The star ratings of travel product suppliers are for your reference only. The star ratings are based on information provided by suppliers, including travel product suppliers, and we do not independently verify the star ratings, nor do we guarantee the accuracy of the star ratings of travel product suppliers. For more specific information, please check the specific content on the website. Please note that location, available options, local market conditions, practices, or other circumstances can greatly affect star ratings. Therefore, the same star rating may feel different in different countries or cities. Star ratings do not necessarily reflect all the facilities or services provided by travel product suppliers, and not all travel product suppliers with the same star rating have the same facilities or services. If you value specific facilities or services, please contact our customer service to inquire whether the travel product supplier has these facilities or services.

IV.  DidaTravel Platform Account Registration and Use

The client confirms that before starting to register and use the products/services of the DidaTravel Platform, the client should have the civil capacity corresponding to the behavior as stipulated by the laws of the People's Republic of China and have obtained valid authorization. If the client does not have the aforementioned civil capacity or authorization corresponding to the behavior, the client and/or user shall bear all consequences arising therefrom in accordance with the law.

You can create a DidaTravel Platform account to use the products/services of the DidaTravel Platform. You can register directly on the DidaTravel Platform using your mobile phone number.

In addition, you can only register a DidaTravel Platform account through the official channels provided by the DidaTravel Platform. You may not obtain a DidaTravel Platform account through methods including but not limited to purchasing, renting, borrowing, sharing, exploiting, or damaging our registration system and/or other methods not permitted by us.

Clients have limited use rights to DidaTravel Platform accounts. Client accounts may not be transferred, leased, lent, sold, shared, or otherwise made available to others (except as otherwise provided by law or with the explicit written consent or authorization of DidaTravel ).

If there is evidence or if DidaTravel determines based on DidaTravel Platform rules that a client has improperly registered or improperly used multiple DidaTravel Platform accounts, the DidaTravel Platform may take measures such as freezing or closing accounts, canceling orders, or refusing to provide services. If the DidaTravel Platform and related parties suffer losses as a result, the client shall also bear liability for compensation.

The content and information on this website, as well as the software and hardware facilities that provide this content and information, are exclusively owned by the DidaTravel Platform or suppliers including hotels. You may only use this website for good faith and legal inquiries or bookings. You should promise not to make any speculative, erroneous, or fraudulent bookings, nor make bookings based on predicted demand. You should agree that the DidaTravel Platform may contact you when necessary.

V. Prices, Additional Fees, and Booking Guarantees

(1) Prices

We are committed to providing the most competitive prices, and we hope that you can stay in hotels or purchase air tickets at the lowest prices.

(2) Additional Fees

Please note that unless otherwise specified, the prices displayed on the website are for the specified check-in or travel dates and the number of people staying or traveling. The website displays the total booking price, and you can expand the total price to view the detailed price. Unless otherwise specified, the booking prices displayed on the DidaTravel webpage include taxes and service fees but do not include any type of insurance (more details below). Without affecting the content below, the total price will be displayed before you confirm the order on the booking final page (before the final confirmation page). Please carefully check each step of the booking process; you can interrupt the booking at any time before the final confirmation page (if you need to cancel a successfully booked order, please see below). The website (below the travel product supplier information or before the final booking confirmation) will list the price details. If you are unsure whether certain items are included in the booking price, you can contact the travel product supplier and our client service team.

If you book a hotel, unless otherwise stated, resort fees and other mandatory fees (see below) and certain local city taxes, tourist taxes, or occupancy taxes (if applicable) that need to be directly charged to the customer are usually not included in the accommodation fee. For details, please refer to the hotel description or policy. Standard hotel rooms are for one or two people. If an extra bed is needed, an additional fee will be charged. If not notified in advance, the hotel may refuse additional people. Please note that if you use certain services at the hotel, the hotel may charge you a mandatory additional "resort fee" (or similar fee), which is also not included in the booking price. Hotels in some regions or countries may directly charge you energy surcharges, baggage handling fees, newspaper delivery fees, in-room security fees, sightseeing fees, or room service fees. DidaTravel cannot prevent hotels from charging similar fees. The booking price generally does not include optional additional fees and personal consumption expenses, such as parking fees, minibar fees, telephone fees, room service fees, food and beverage fees, banquet fees, movie rental fees, internet fees, etc. During some peak seasons, certain hotels may charge mandatory banquet fees (e.g., New Year, Christmas, Spring Festival, etc.). Some local governments may require hotels to directly charge clients local bed taxes or city taxes, or issue instructions to levy additional taxes and require hotels to directly charge clients. If these fees exist, you should pay them directly to the hotel at checkout. The above fees will not be included in the booking price, but they will be listed in the booking form. Please check the "Hotel Information," "Booking Conditions," "Cancellation Policy," or similar provisions on the website.

If you book an air ticket, unless otherwise stated, the booking price does not include the following fees: fees incurred due to excess baggage, pet transportation, special item consignment, additional meals, in-flight WiFi, online check-in and seat reservation, cabin class upgrade, or errors in passenger information provided by the passenger that require modification. Please carefully check the "Ticket Refund and Change Rules," "Baggage Allowance," or similar provisions on the website before booking.

Some hotels or airlines may require you to pay hotel transportation service fees or airport transfer service fees in addition to the booking price. Please note that DidaTravel does not provide any transportation services. These are usually arranged or provided by hotels or airlines, not DidaTravel. DidaTravel does not assume any responsibility for the quality, safety, density, or service level of such transportation services.

For your convenience in transactions with hotels or airlines, the booking prices displayed on the DidaTravel website include basic taxes and service fees. The above fees are collected by us on behalf of hotels or airlines, including but not limited to use taxes, occupancy taxes, room taxes, consumption taxes, value-added taxes, airport construction fees, fuel surcharges, and/or other similar taxes or fees. In some places, the tax amount may include government-imposed service fees or other fees that are not directly paid to the tax authorities but are collected by hotels or airlines according to the law.

We are not a seller of hotels or airlines, nor are we a service provider. Except for the special circumstances described below, we do not collect taxes on behalf of tax authorities. Our hotel or airline suppliers, as sellers, charge us according to all applicable taxes, and we pay these amounts directly to the sellers. We are not partners of the sellers; we only book or arrange travel arrangements for customers. Depending on the location, tax capacity, special purposes, tax rates, and tax types will vary.

As mentioned above, some cities or municipalities charge additional taxes and fees and require local travel product suppliers to collect them.

The above related fees are collected by the actual service provider of the booking. For the invoice issuance method (issued by the service provider or the hotel front desk, etc.), please refer to the display of related products/services on the DidaTravel Platform.

(3) Booking Guarantee

Clients who book travel products through the DidaTravel system can enjoy our booking guarantee. For example: After you successfully book, when you check in at the hotel (after printing the hotel check-in voucher) or at the airport (after obtaining the ticket number issued by the airline through DidaTravel), if the booked room/flight is no longer available or the booking is not accepted by the hotel/airline, please contact our client service center in time. DidaTravel client service specialists will immediately arrange a free room of the same level at a conveniently located hotel of the same level for you/arrange a free flight of the same class within 24 hours of the original travel time for the passenger, and arrange reasonable and necessary accommodation for the passenger at the original departure and transit locations (the accommodation standard is a five-star hotel for first-class passengers (including first-class suites and other cabin services with the word "First"), a four-star hotel for business-class passengers, and a three-star hotel for economy-class passengers (including super economy class/premium economy class/advanced economy class and other cabin services with the words "Economy" or "Coach"). If there is no star rating in the local hotel industry, DidaTravel will make arrangements at its discretion. Unless we authorize clients to make their own arrangements, the above alternative travel products must be selected and booked directly by us, otherwise we will not bear the relevant compensation liability.

If you do not agree with the alternative travel products arranged by us, DidaTravel will refund the full amount of your booking fee.

VI. Booking Conditions - Cancellation, No-Show, Late Check-In/Changes, and Special Requests

By making a booking through our website, you accept and agree to the relevant booking conditions of the travel product supplier (including cancellation, changes, or no-show applicable to the booking), as well as any additional (delivery) conditions of the travel product supplier applicable during your booking or travel period, including the services or products provided by the travel product supplier (additional conditions can be obtained from the corresponding travel product supplier). The travel product supplier's cancellation policy, change policy, no-show policy, or change policy can be viewed on the travel product supplier information page or under "Booking Conditions," "Cancellation Policy," or similar provisions on this website. Please note that according to the aforementioned policies, you may need to pay corresponding fees for canceling a booking. We recommend that you carefully read the travel product supplier's cancellation policy, change policy, no-show policy, or change policy before booking. Please thoroughly review the cancellation policy, change policy, no-show policy, or change policy before making a reservation.

If you are booking a hotel, any cancellation request made after the latest cancellation date specified in the booking (including the latest cancellation date) will require payment of at least one night or more as a cancellation fee. Additionally, failure to arrive at the hotel on the check-in date of the order will be treated as a cancellation, and at least one night or more will be charged as a cancellation fee for each room. Unless otherwise notified in advance, the cancellation policy at the time of booking will apply.

If you are booking a flight, please refer to the refund, change, and transfer rules clearly stated on our website at the time of booking. Except for impacts caused by force majeure, we will follow these rules for subsequent services and charge corresponding service fees. Unless otherwise notified in advance, the change and refund policy at the time of booking will apply.

If any modifications or cancellations (partial or full) to the order are required, they must be made directly through the DidaTravel system, not by contacting the travel product supplier directly. Fees arising from modifications will be recharged to the customer by the DidaTravel system. Some travel products cannot be modified once successfully booked, and any losses resulting from this will be borne by the client. If you have any questions or concerns before or during your stay/travel, please contact our client service team directly.

Special Requests: If you have any special requirements (e.g., wheelchair accessibility), you should contact customer service or the hotel/airline directly to confirm that these requests can be accommodated. Please note that all special requests are subject to availability, and the  DidaTravel System cannot guarantee their fulfillment.

Service Guarantee

1. Overbooking Handling

We have arranged 24-hour customer service center to resolve issues for customer and promise to follow the following deadlines if the hotel cannot locate your booking or is overbooked.

  1. Upon check-in, we will provide a solution within one hour of receiving the call.
  2. We will reconfirm the booking with the original hotel or arrange another hotel. If the customer cancels or rebooks before we provide the final solution, we will not bear any price difference or compensation.

2. Relocation Policy

  1. In the event of overbooking, if the upgraded room type at the original hotel is unavailable, a hotel of the same or higher star rating will be provided as an alternative. We will provide up to two relocation options to the customer's designated email address or contact. Please note that star ratings are based on data agreed upon with our partners.
  2. Once the guest accepts the alternative hotel, please notify us immediately to confirm the new booking. Once the relocation is accepted, the booking cannot be canceled or changed.
  3. If the guest does not accept the relocation, the customer is obligated to **provide an invoice or voucher from the hotel** as proof to apply for compensation.

Compensation Standards for Overbooking

Supplier offers alternative
Guest accepts alternative hotel

High-star hotels within three kilometers, no compensation.

For downgraded hotels, the supplier pay for downgraded price differences.

Guest does not accept alternative hotel

The supplier cancels the order for free. Any price difference between the new and original bookings shall be covered by the responsible party, with the maximum compensation not exceeding the full amount of the first night's room rate.

Supplier unable to find alternative hotels to guest

Non-Compensable Scenarios:

1. If we successfully provide the customer with a hotel of the same or higher star rating within a 3-kilometer radius, but the customer declines the offer, they may cancel free of charge without compensation.

2. Compensation claims will only be processed after check-out. All supporting documents must be submitted within 1 month after check-out. Failure to submit within this period will result in automatic forfeiture of the claim.

Valid invoice/documentation must include:

• Guest name, booking amount and currency, new hotel name, new booking ID/confirmation number, and new room type.

• The hotel’s city, guest name, and check-in dates must match the original booking.

3. Failure to Notify Us Immediately: If the customer does not contact us promptly regarding booking issues and makes independent arrangements, they will forfeit the “Service Guarantee” benefit. No compensation will be provided, and we assume no responsibility for any costs incurred (including but not limited to bookings involving malicious purchasing practices).

4. We do not accept splitting group reservations into multiple individual bookings. If such splitting leads to hotel actions (e.g., additional charges at check-in, cancellation of related bookings, or last-minute hotel changes), we assume no responsibility.

5. If the customer violates Dida global hotel distribution policies (e.g., listing on unauthorized OTAs such as Ctrip, Qunar, Elong, or Meituan), we reserve the right to cancel the booking, deduct the full room charge, deny compensation, and pursue further actions per hotel policies.

6. If we or the hotel confirm that a guest has made duplicate reservations, the booking may be canceled without compensation.

7. Check in by the hotel’s stated latest check-in time. If no time is specified, check in by 22:00 on the first night. Failure to check in on time without prior notice may result in full cancellation of your booking without refund or compensation.

3. Amendments

Amendments such as the number of guests, guest names, number of rooms, breakfast, length of stay, etc., can be divided into the following situations. We do not guarantee any results for amendments.

  1. Before the cancellation deadline, customers may cancel and rebook as they wish.
  2. After the cancellation deadline, any amendments or cancellations will incur a full penalty fee according to the policy.
  3. Special bookings due to force majeure events should be negotiated and resolved promptly by both parties.

4. Special Requests

Guests are advised to first confirm any doubts about their hotel stay (room type, breakfast, etc.) with the hotel. If guests are still unsatisfied with the hotel's response, we will provide further assistance. Please note that special requests cannot be guaranteed and are subject to hotel availability.

5. Cancellation

Bookings will be processed according to the cancellation policy displayed to the customer. Special requests for non-refundable bookings will be handled on a case-by-case basis. We do not guarantee any fee waivers.

Please note that any terms negotiated directly between the customer or guest and the hotel without our involvement and prior notice may not be considered final.

6. Fee Waivers

Fee waivers for cancellations, no-shows, or early departures will be handled on a case-by-case basis. We will actively coordinate with the customer but cannot guarantee any results for special exceptions.

7. Post-Travel Support

In any event, we must be informed of all post-travel complaints within 30 days after the check-out date.

8. Additional Charges

If guests are overcharged by the hotel for our booking, please contact us immediately. Providing proof such as bills or credit card statements will help us appeal to the hotel. We will attempt to recover the additional charges for the customer, but this depends on the progress of the hotel and the bank. Typically, domestic remittances may take 7 to 14 business days, and international remittances may take 30 business days.

9. Fraudulent Bookings

As we are not the ultimate service provider, we are not responsible for any fraudulent bookings. Requests for cancellation fee waivers will be handled on a case-by-case basis, with the final decision made by the hotel. We will actively coordinate with the customer but cannot guarantee any results for special exceptions.

10. Special Situations

In some special situations that are clearly beyond our control, we will make reasonable efforts to find the best solution for the customer based on our capabilities.

11. Hotel Closures and Renovations

If a hotel is closed or temporarily closed due to renovations, affecting the stay dates, services, or customer experience, we will provide an alternative hotel according to the relocation policy. If the customer declines the alternative offered by us, the booking will be canceled and fully refunded without any compensation. The customer is welcome to suggest an alternative that meets our conditions, but please note that we will not cover any additional costs for the new booking.

12. Force Majeure

In the event of a severe weather advisory or force majeure affecting a certain region, we may agree to a blanket waiver, including the waiver of any/all cancellation penalties for bookings in the affected region during the valid dates. All weather advisories and force majeure events will be communicated via email.

VII. Travel Advice - Visa Requirements

We would like to draw your attention to the significant safety risks associated with traveling to certain destinations. Please review travel bans, warnings, announcements, and recommendations issued by the government or local embassies and consulates before booking your trip, especially for international travel.

The DidaTravel system displays hotel information for specific locations, but this does not imply a recommendation to travel to these places or that there are no risks involved. DidaTravel is not responsible for any damages or losses incurred from traveling to these destinations, nor is it liable for any accidents that may occur during your stay at the hotel or while traveling. It is strongly advised that you check the relevant travel announcements issued by the government of the country you plan to visit and take necessary precautions. Additionally, it is recommended that you purchase personal travel insurance.

It is your responsibility to obtain all necessary travel documents.DidaTravel is not responsible for any losses incurred if you fail to carry the required passport, visa, or documents. It is suggested that you verify with the relevant country's embassy and/or visa department.

Please note that some countries have strict regulations on restricted or prohibited imports. These items include, but are not limited to, alcohol, tobacco, perfumes, medications, books, films, CDs, adult entertainment materials, food, plants, and animal products. Please verify and comply with the applicable laws and regulations.

VIII. Amendments to the Terms of Service

In accordance with changes in national laws and regulations, operational needs, or for the purpose of improving service quality, DidaTravel may modify or update this agreement and/or various rules as necessary, and will announce or notify in advance on the corresponding pages of the DidaTravel platform. The amended/updated text will take effect on the date specified in the relevant update notice, but DidaTravel  promises to announce or notify at least seven days before the text takes effect.

Clients should promptly review and understand the relevant amendments/updates. If a client disagrees with the relevant amendments/changes, they have the right to contact the DidaTravel  platform to provide feedback before the effective date of the changes. If your feedback is adopted, DidaTravel will adjust the changes accordingly. If a client still disagrees with the amended/changed content after it has taken effect, they may stop using the products/services involved in the amended/changed content on the DidaTravel platform. In this case, the amendments/changes will not be effective for you; if a client continues to use the products/services involved in the amended/changed content on the DidaTravel platform after the implementation of the amendments/changes, it will be deemed that the client has agreed to all revisions/changes.

IX. Service Changes, Interruptions, Termination

You fully understand and agree that this service involves internet and mobile communication services, which may be affected by various unstable factors. Therefore, DidaTravel is not liable for any losses caused by service interruption, cancellation, or termination due to force majeure, computer viruses or hacker attacks, system instability, your location, device shutdown, GSM network, internet, communication lines, or other factors beyond the control of the DidaTravel platform, to the extent permitted by law.

The DidaTravel platform needs to regularly or occasionally inspect or maintain the platform or related equipment that provides network services. If such activities cause an interruption of network services (including paid network services) within a reasonable time, DidaTravel is not responsible, but the DidaTravel platform should try to notify in advance.

You fully understand and agree that, except as otherwise provided in this service agreement, given the special nature of network services, the DidaTravel platform may change, interrupt, or terminate part or all of the network services. Except for products/services that you have already ordered or applied for through the DidaTravel platform and have completed payment and received confirmation of the order or application, DidaTravel is not responsible for any changes, interruptions, or termination of services, but DidaTravel should try to notify in advance and give you as much time as possible to deal with related rights.

DidaTravel is not responsible for the following reasons that may cause obstacles, defects, delays, or changes in the performance of the contract:

(1) Force majeure factors such as natural disasters, strikes, riots, wars, government actions, judicial and administrative orders, hacker attacks, technical control by telecommunications departments, major infectious disease outbreaks and other public health emergencies, changes in national tax and other related policies;

(2) Public service factors or third-party factors such as power supply failures, communication network failures;

(3) Under the circumstance that DidaTravel has exercised due diligence, factors such as routine or emergency equipment and system maintenance, equipment and system failures, network information and data security.

X. Code of Conduct for Clients

When using the products/services of the  platform, clients must comply with the relevant laws and regulations of the People's Republic of China. Clients promise not to use the products/services of the DidaTravel platform for any illegal or improper activities, including but not limited to the following behaviors:

  1. Uploading, displaying, posting, disseminating, or otherwise transmitting information containing any of the following content:
  1. Opposing the fundamental principles established by the Constitution of the People’s Republic of China;
  2. Endangering national security, disclosing state secrets, subverting state power, or undermining national unity;
  3. Damaging national honor or interests;
  4. Inciting ethnic hatred, ethnic discrimination, or undermining ethnic solidarity;
  5. Violating state religious policies, promoting cults or feudal superstitions;
  6. Spreading rumors, disrupting social order, or destabilizing social stability;
  7. Disseminating obscenity, pornography, gambling, violence, murder, terrorism, or content that incites criminal acts;
  8. Insulting or defaming others, infringing upon others’ lawful rights;
  9. Containing false, harmful, coercive content, invading others’ privacy, harassment, infringement, slander, vulgarity, indecency, or other morally objectionable material;
  10. Inducing minors to imitate unsafe behaviors, violate social ethics, or develop harmful habits;
  11. Violating other content restrictions or prohibitions under Chinese laws, regulations, rules, ordinances, or any legally binding norms.
  1. 2. Accessing the DidaTravel Platform or using DidaTravel products/services for any unlawful purpose, or engaging in the following unauthorized activities:

(1) Unauthorized access to computer information networks, illegally obtaining or using network resources;

(2) Unauthorized deletion, modification, or alteration of computer network functions;

(3) Unauthorized deletion, modification, or tampering with data or applications stored, processed, or transmitted within computer networks;

(4) Intentionally creating or disseminating destructive programs (e.g., computer viruses) or other acts endangering network security;

(5) Commercial exploitation of any data from the DidaTravel Platform without prior written consent, including but not limited to:

Using web crawlers, copying, disseminating, or otherwise extracting/utilizing platform data.

(6) Engaging in illegal activities such as money laundering, trade secret theft, personal information theft, cash-out fraud, or impersonating DidaTravel to spread false/fraudulent information;

(7) Interfering with normal platform operations or transactions via devices, software, scripts, or actions that impose unreasonable data loads on network infrastructure;

(8) Unfair competitive acts (e.g., false transactions, malicious orders) that violate good faith principles or disrupt transaction integrity;

(9) Non-transactional activities, such as unauthorized advertising (unless expressly permitted byDidaTravel );

(10) Posting content that infringes DidaTravel’s or others’ legal rights, violates laws/regulations (e.g., Internet Audiovisual Program Service Management Rules, Online Information Content Ecosystem Governance Provisions), or breaches this agreement.

  1. Acts Disrupting Transaction Order, including but not limited to:

(1) Purchasing services/products exceeding genuine consumption needs;

(2) Manipulating transactions or activities through plugins, exploits, or other unfair means;

(3) Unfair competition (e.g., fake reviews, fabricated transactions to manipulate ratings);

(4) Malicious orders, false claims, or fraudulent transactions.

Consequences:

  • Any such acts constitute material breach of this agreement.
  • DidaTravel reserves the right to, without prior notice:

Delete violative content.

Suspend or terminate your access to products/services.

  • You bear legal liability for your actions on the Platform.
  • Evidence of illegal activities (e.g., violations of laws or public order) may be reported to relevant authorities.

XI. Client Information and Privacy Rights Protection

1.Respecting the personal information and privacy rights of customers and users is a fundamental policy of  DidaTravel. During your use of the products/services of the DidaTravel platform,  DidaTravel will employ relevant technical measures and other security measures to protect your personal information and privacy rights.

2. places great emphasis on the protection of personal information and privacy rights of minors, therefore:

(1) If you are a minor, you should read this agreement under the supervision and guidance of your guardian, and the use of DidaTravel 's products/services has been consented to by your guardian;

(2) If you are the guardian of a minor, you should guide them on the safety issues they should pay attention to while surfing the internet. If you agree to a minor using the products/services of the  DidaTravel platform, you must apply for transactions or handle consumption (if involved) in your name, and provide correct guidance and supervision for the minor's use of the DidaTravel platform's products/services. The use of the DidaTravel platform's products/services by a minor through your account, as well as the exercise and fulfillment of the rights and obligations under this agreement, is deemed to have received your recognition.

For more information on the rules of personal information processing and privacy rights protection, users' control over personal information, the processing of minors' personal information and privacy rights protection, etc., please consult DidaTravel's "Personal Information Protection Policy" through the DidaTravel platform.

XII. Legal

1.Intellectual Property Rights

Unless otherwise stated, the intellectual property rights (including copyrights) of all kinds of software, content, information, and materials used in our services are owned by Shenzhen DidaTravel Technology Co., Ltd., its travel providers, or suppliers.

Shenzhen DidaTravel Technology Co., Ltd.exclusively reserves all rights to the proprietary intellectual property involved in providing the service platform. Without our explicit written permission, you are not allowed to copy, scrape, create (hyper/deep) links, publish, promote, sell, integrate, utilize, combine, or otherwise use any content or our intellectual property.

2. Disclaimer of Liability

All content, including software, products, services, information, documents, and related materials, is provided to you on an "as-is" and "as-available" basis. DidaTravel Systems makes no express or implied representations, warranties, or guarantees regarding the operation of the website, its content, or materials, and to the fullest extent permitted by applicable law, expressly disclaims all such representations, warranties, or conditions, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, non-infringement, or title;
  • Warranties regarding accuracy, reliability, completeness, timeliness, or utility of information;
  • Warranties that the website will operate continuously, error-free, or free of viruses, defects, or harmful components.

DidaTravel Systems shall not be liable for any failures, damages, or losses arising from:

  • Server errors, misdirected transmissions, network connection failures, booking transmission/reception interruptions, computer viruses, or technical defects (whether human or technical);
  • Loss or theft of your account (you assume full responsibility for account management and security).

Flight Booking Obligations:

  • You warrant that all information provided for flight bookings (e.g., passenger name, date of birth, valid ID, contact details) is accurate, complete, and lawful. DidaTravel disclaims liability for losses caused by inaccurate or fraudulent information, including denied boarding or correction fees.
  • You bear sole responsibility for transaction legality. DidaTravel reserves the right to refuse misuse of airline fares, GDS systems, or related equipment.

Enforcement Under IATA BSP/ARC Rules:

  • Airlines may issue Agent Debit Memos (ADMs) within 13 months post-ticketing for non-compliant sales practices (e.g., GDS misuse, ticket splitting, no-show flights). If such violations are attributable to your account:
  • DidaTravel may suspend, restrict, or terminate your account access;
  • DidaTravel retains full recourse to recover direct/indirect losses from you.

Flight Reservation Terms:

  • Orders are held for 30 minutes post-creation. Failure to pay within this period permits DidaTravel to cancel the booking. Extensions may be requested but are not guaranteed.
  • Final pricing is subject to airline adjustments (e.g., fare/seat availability).DidaTravel may cancel orders within 4 hours of airline notifications regarding fare errors, without liability.
  • Duplicate bookings for the same passenger/itinerary via third-party platforms may result in airline cancellations. DidaTravel disclaims liability for such losses.

3. Governing Law, Jurisdiction, and Dispute Resolution

These Terms of Service and the services we provide shall be governed by and construed under the laws of the People's Republic of China. Any disputes arising from or related to these Terms and Conditions or our services shall be submitted to the competent people's court in the jurisdiction where Shenzhen DidaTravel Technology Co., Ltd. is located.

If any provision of these Terms of Service is deemed invalid, unenforceable, or void, you shall remain bound by the remaining provisions of these Terms and Conditions. Alternatively, you shall at least agree to accept new terms that align with the regulatory purpose of the invalid, unenforceable, or void provision.

XIII. Miscellaneous

DidaTravel System does not, in any manner (directly or indirectly, independently or in association with any party), own, manage, operate, or control travel product suppliers or the travel products they provide. Customers who successfully book through DidaTravel System will receive travel products or related services directly from DidaTravel’s suppliers.

You agree to indemnify and hold DidaTravel harmless from any liability, damages, or losses. If DidaTravel incurs any losses, costs, or expenses due to your acts, omissions, or negligence, you shall compensate DidaTravel accordingly. If you use the DidaTravel System on behalf of a third party (e.g., family members or travel companions), you assume full responsibility for any inaccuracies arising from improper use. You must also inform such third parties of all applicable terms and conditions. Each user acting on behalf of a third party agrees to release DidaTravel from any liability, loss, injury, claims, or litigation (including legal fees).

You are subject to local laws and regulations. Matters lawful in one country may be unlawful in another, and you should consult applicable restrictions. DidaTravel bears no responsibility if a travel product supplier denies or terminates services due to legal or regulatory reasons.

Severability: The provisions of these Terms are severable. If any provision is deemed unenforceable or invalid under applicable law, it shall be modified to the fullest extent permissible to reflect the original intent, without affecting the validity or enforceability of the remaining provisions.

Modification and Termination: DidaTravel reserves the right to modify, suspend, or terminate the website and/or its services (including specific products) at any time and for any reason, at its sole discretion. Even if the website is terminated, your obligations under these Terms (including warranties), disclaimers, and liability limitations remain binding. DidaTravel assumes no liability for termination of your or any third party’s access. DidaTravel further reserves the right to amend or revoke these Terms (or any part thereof) as it deems appropriate.

Waiver and Assignment: Failure to enforce any right under these Terms does not constitute a waiver of such right. You may not assign or transfer any rights arising from these Terms.

Conflicting Agreements: If you enter into a separate agreement or arrangement with DidaTravel regarding a transaction, and such agreement conflicts with these Terms, the separate agreement shall prevail.

【服务协议的确认和接纳】


道旅平台由深圳市道旅旅游科技股份有限公司运营,涉及具体的旅游服务或产品(以下简称“产品/服务”),由具备资质的服务商提供。道旅系统通过网站及小程序为您提供预订平台。如果您在本网站、或其他提供道旅预定服务的移动应用或软件上(以下简称“道旅平台”或“我们”),访问、预订或使用产品/服务,便视为您接受了《道旅平台服务协议》(以下简称“本协议”)。您在确认注册成为道旅用户(以下简称“客户”或“用户”)前,请您务必审慎阅读、充分理解合同中的相关条款内容,尤其是以下加粗字体部分话术。如果您不同意以下任何内容,请立刻停止访问道旅平台/使用道旅平台所提供的任何产品或服务。


一、总则


本协议内容包括协议正文、道旅平台子频道各单项服务协议及其他道旅平台已经发布的或将来可能发布的各类规则,包括但不限于免责声明、个人信息保护政策、Cookies协议、个人信息授权声明、产品预订条款/预订须知等其他协议(“其他条款”)。如果本协议与“其他条款”有不一致之处,则以“其他条款”为准。除另行明确声明的情形之外,任何道旅平台提供的产品/服务均受本协议约束。


本协议中,“道旅”是指包括包括道旅平台的开发者和运营者深圳市道旅旅游科技股份有限公司。“关联公司”指深圳市道旅旅游科技股份有限公司旗下所有公司及其附属、关联公司,包括但不限于深圳市幸游国际旅行社有限公司、深圳市友道旅游有限公司、贴心(深圳)旅行社有限公司,浙江幸游旅游服务有限公司等,以下单独或合称“道旅”或“我们“。


本协议中,“道旅平台”指域名以【didatravel.com及dida.com】为主的网页及客户端(包括微信小程序或H5页面),客户端适用的终端设备包括但不限于PC、平板电脑、手机等。


本协议中,“用户”或”客户“指访问或使用道旅平台所提供的产品/服务的自然人或法人。您注册成功后需尽快完成道旅平台的企业认证以证明您已获得注册时所填写企业的完全授权。若您作为道旅客户登录道旅平台,访问道旅平台或使用道旅服务,即视为您同意本协议的所有条款及道旅公布的其他规则、说明和操作指引。本协议由您(或简称“客户”、“用户”)与深圳市道旅旅游科技股份有限公司(统一简称“道旅”),本着互惠互利的原则,共同缔结。


二、 服务范围及网站信息


道旅系统通过网站及小程序为您提供一个平台,您可藉由该平台浏览不同类型的旅游产品,包括但不限于酒店(包括招待所、酒店式公寓、旅馆、民宿)、机票等。您通过网站进行预订,代表您愿意按照所列预订价格预订旅游产品,并愿意遵守网站规定的其他条件,如果道旅系统接受了预订,并向您显示预订成功的提示,则成立对双方都有约束力的合同,亦代表旅游产品供应商确认了您的预订。如果我们接受了您的旅游产品预订或者预订不成功,我们保留下文所述之拒绝预订的权利。


我们根据供应商[包括但不限于供应商及其代表、经销商、目的地管理公司(DMCs)、渠道经理、合伙人等]提供给我们的信息向您发布旅游产品的相关信息,由深圳市幸游国际旅行社有限公司、深圳市友道旅游有限公司通过道旅平台为用户提供预订住宿服务,住宿服务由住宿服务提供方(酒店、旅舍等)提供,其他旅游产品/服务由其他关联公司提供预订服务。我们在提供服务时会尽力作出合理管理,但是我们无法保证信息的准确性、完整性、真实性和时效性,更不会对错误(包括明显的和印刷错误)、中断[无论是否因网站(暂时及/或局部)的故障、修理、升级或维护或其他原因]、不准确、误导性或不真实的信息或未发布的信息负责。市场行情或环境的突然变化可能会导致网站上发布的信息不够准确或者不合时宜。如遇问题,我们的客户服务会作出合理的协助,并充当您与旅游产品供应商的中间人。


本网站列出旅游产品供应商名称,其并不意味着也不应该被视作推荐该旅游产品供应商,或为该旅游产品供应商(服务质量、水平或评级)背书。我们在此申明我们不代表、保证或承诺网站所列旅游产品供应商的质量、状况或适宜性。我们保留以任何理由自由决定拒绝或接受客户的预订(或在特殊情况取消已经确认的预订)的权利,并无需对其加以证明。通常我们拒绝客户预订的原因包括但不限于:旅游产品供应商的要求、客户违反服务条款、贸易或经济制裁、禁令、法律限制、(怀疑)诈骗或偷窃、刑事案件嫌疑犯、可疑预订、客户提交误导或错误信息、行为不当、威胁、侮辱、拒绝提供信息、实际障碍、沟通问题、明显错误(定义见下文)、客户不当的历史记录、列入政府或国际组织(美国、欧盟、联合国、新加坡......)的黑名单中等。如果道旅系统拒绝或者取消预订,而您已支付了费用,我们将退还所有的预订费用给您。我们也保留自由决定拒绝用户暂时或永久访问道旅系统的权利。


我们偶尔以“明显错误”为由取消或拒绝预订,而不管错误产生的原因。为清晰起见,明显错误是指一般理性人认为不应该在网站上出现的错误(例如,有关于价格)。在这种情况下,我们会将已收费用偿还给客户。道旅可以全权决定是否因该理由取消或拒绝预订。


请注意我们可拒绝可疑的团体预订,因为大多数旅游产品供应商对团体预订有特殊程序。欲知更多信息,请联系我们的客户服务组。


进行中的翻新、旅游产品预订错误及个别的顾客需求等情况均可能影响您的入住质量或航行质量。请确保入住时或出行时将您具体的需求和要求直接告知旅游产品供应商。


三、关于旅游产品供应商星级评定

旅游产品供应商星级评定仅供您参考。星级评定是基于包括旅游产品供应商在内的供应商提供的信息所作出,我们并不独立地对星级评定进行验证,亦不对旅游产品供应商星级评定的准确性提供保证责任。欲知更多具体信息,请查看网站的具体内容。请注意,地点、可提供的选择、当地市场行情、实践或者其他情况,都能大大影响星级评定。因此,相同的星级评定于不同的国家或城市,会有不同的实际感受。星级评定并不必然反映旅游产品供应商可提供的所有设施或服务,并不是有着同样星级评定的旅游产品供应商都有相同的设施或服务。如果您很重视特定的设施或者服务,请联系我们的客户服务询问旅游产品供应商是否具备这些设施或者服务。


四、道旅平台账户注册和使用


客户确认,在客户开始注册使用道旅平台的产品/服务前,应当具备中华人民共和国法律规定的与行为相适应的民事行为能力,并已取得合法有效的授权。若客户不具备前述与行为相适应的民事行为能力或授权,则客户和/或用户应依照法律规定承担因此而导致的一切后果。


您可以创建一个道旅平台账户来使用道旅平台的产品/服务。您可以直接在道旅平台使用您的手机号注册。


除此之外,您仅可通过道旅平台官方提供的渠道注册道旅平台账户。您不得通过包括但不限于购买、租用、借用、分享、利用或破坏我们的注册系统及/或其他未经我们许可的方式获得道旅平台账户。


客户享有道旅平台账户的有限使用权,客户的账户不得以转让、出租、出借、售卖、分享或其他任何方式交由他人使用(但法律另有规定或道旅明确书面同意或授权的除外)。


如有证据证明或道旅根据道旅平台规则判断客户是否存在不当注册或不当使用多个道旅平台账户的情形,道旅平台可采取冻结或关闭账户、取消订单、拒绝提供服务等措施,如给道旅平台及相关方造成损失的,客户还应承担赔偿责任。


本网站的内容和信息,及提供这些内容和信息的软硬件设施,为道旅系统或包括酒店在内的供应商专属所有。您只能使用本网站进行善意合法的咨询或预订,您应在此承诺不做任何投机的、错误的或欺诈性的预订,也不在预测需求的基础上进行预订。您应该承诺同意道旅系统在必要情况下联系您。


五、 价格、附加费用及预订保证

(1)价格

我们致力于提供最有竞争力的价格,我们希望您能够以最低的价格入住酒店或购买机票。


(2)附加费用

请注意,如无特别标明,网站显示的价格符合规定的入住或出行日期和入住或出行人数。网站显示的是预订总价格,同时您可以展开该总价格查询明细价格。如无特别标明,道旅在网页上显示的预订价格已含税费和服务费,但不包含任何类型的保险(更多细节参见下方)。对下方内容没有影响的情况下,总价格将在您在预订尾页(最后确认页面前)确认订单前显示。请仔细核查预订流程上的每个步骤;在最后确认页面前您可以随时中断预订(如需取消已预订成功订单请见下方)。网站(旅游产品供应商信息下方或最后预订确认前)将列出价格清单,如您不确认某些事项是否包含在预订价格内,您可以联系旅游产品供应商以及我们的客户服务组。


如您预订酒店,除非另有说明,否则度假村费用和其他强制费用(见下文)以及需要向客户直接收取的某些本地城市税、旅游税或占用税(如果适用),通常不包含在住宿费里,具体请详见酒店说明或政策。酒店标准房间供一人或两人入住,如需加床,将收取额外的费用。如未提前通知,酒店可能会拒绝额外的人员入住。请注意,如您使用了酒店的某些服务,酒店可能会向您收取强制性附加“度假村费用”(或类似费用),预订价格中亦未包含该费用。部分地区或国家的酒店可能直接向您收取能源附加费、行李处理费、送报费、室内安全费、观光费或客房服务费,道旅无法阻止酒店收取类似的费用。预订价格中一般也不包含可选附加费和个人消费的支出,例如停车费、迷你吧费、电话费、客房服务费、食物及饮料费、晚宴费、电影租赁费、上网费等。在部分旺季期间,某些酒店会强制收取晚宴费(例如新年、圣诞节、春节等)。一些地方政府会要求酒店直接向顾客收取当地的床税或城市税,或者下达一些征收附加税的指令并会要求酒店直接向顾客收取,如果存在这些费用,您应在结账时直接向酒店支付。预订价格中将不会包含上述费用,但在预订表格中都会将其列出来,请于网站查看“酒店信息”、“预订条件”、“取消政策”或类似规定。


如您预订机票,除非另有说明,否则预订的价格中将不包含下述费用:由于行李超额、宠物运输、特殊物品托运,额外餐食、机上WIFI、在线值机及座位预留、提升舱位等级或旅客提供个人信息错误导致需要修改相关信息而额外产生并收取的费用,请在预订前于网站认真查看“客票退改规则”、“行李额度”或类似规定。


某些酒店或航空公司会要求您必须在预订价格之外支付酒店交通服务费或者接送机服务费。请注意,道旅不提供任何交通服务,这些通常是由酒店或航空公司安排或提供,而不是道旅。道旅对该等交通服务的质量、安全、密度或服务水平不承担任何责任。


为了方便您与酒店或航空公司的交易,道旅在网站上显示的预订价格已包含基本的税费和服务费,上述费用为我们替酒店或航空公司代收,包括但不限于使用税、占用税、房间税、消费税、增值税、机场建设费、燃油附加费及/或其他类似的税收或费用。在部分地方,税收金额可能包括政府强加的服务费或其他依据法律不直接向税务机关缴纳而由酒店或航空公司收取的费用。


我们不是酒店或航空公司的销售商,亦不是服务提供方,除下述特殊情況,我们不为税务机关代收税款。我们的酒店或航空公司供应商,作为销售商,按照所有的适用税向我们收取款项,我们将这些金额直接支付给销售商。我们并非销售商的合伙人,我们仅向其预订或预约客户的旅行安排。依地点不同,纳税能力、专用目的、税率及税种亦将不同。


如上所述,某些城市或直辖市收取额外的税费,并且要求当地旅游产品供应商代收。


上述相关费用由实际提供预订的服务方收取,相关发票开具方式(由服务方开具或酒店前台开具等方式)请参见道旅平台相关产品/服务的展示。


(3)预订保证

顾客通过道旅系统预订旅游产品,能够享受到我们的预订保证,例如:当您成功预订后,在到达酒店(已打印出酒店入住凭证)或机场(已通过道旅获取航空公司发放的客票号码)办理入住或值机时,如所预订的客房/客机已无空房/空舱座位或预订不被酒店/航空公司接受,请及时与我们的客户服务中心联络,道旅客户服务专员将会立即为您在位置便利的同等级别酒店安排免费同等级别的客房/安排乘机人在原定旅行时间起的24小时内的同等舱位的免费航班旅行,同时安排乘机人在原始发地及中转地合理且必需的住宿(住宿标准为为头等舱(包括头等套房等含有“First”字样的客舱服务)旅客安排五星级酒店,为商务舱旅客安排四星级酒店,为经济舱(包括超级经济舱/尊享经济舱/高级经济舱等含有“Economy”或”Coach”字样的客舱服务)旅客安排三星级酒店。若当地酒店行业无星级划分,则由道旅酌情安排。除非我们授权顾客自行进行安排,上述替代的旅游产品须由我们直接选择并预订,否则我们将不承担相关赔偿责任。


如果您不同意我们为您安排替代的旅游产品,那么道旅将会就您预订的费用进行全额退款。


六、预订条件 - 取消预订、未入住或未按时入住/退改签、特殊需求

通过我们网站进行预订,表明您接受和同意旅游产品供应商的相关预订条件(包括适用于该预订的取消、变更或未享用),及您在预订或出行期间适用的旅游产品供应商附加(交付)条件,包括旅游产品供应商提供的服务或产品(可从相应旅游产品供应商获知其附加条件)。在本网站的旅游产品供应商信息页或“预订条件”、“取消预订政策”或类似规定项下可以查看旅游产品供应商的取消预订政策、变更预订政策、未入住政策或退改签政策。请注意,根据前述政策,您可能需要因取消预订而支付相应费用。我们建议您在预订前仔细阅读旅游产品供应商的取消预订政策、变更预订政策、未入住政策或退改签政策,请在预订前仔细彻底地查看取消预订政策、变更预订政策、未入住政策或退改签政策。


如您预订的是酒店,任何在超过预订中所规定的最迟取消日后(包含最迟取消日当天)提出的订房取消申请,需要支付至少一晚或更多的房费作为取消费。此外,未能在订单入住日内到达酒店将被视同为取消订房,每间房间必须支付至少一晚或更多的房费作为取消费。除事先做出特别告知,否则将按照预订时的取消政策来受理。


如您预订的是机票,请参照预订时我们网站明确注明的退票、改期、签转规则,除由于不可抗力产生的影响,我们将按照此规则进行后续服务并收取相应的服务费用。除事先做出特别告知,否则将按照预订时的退改签政策来受理。


如果需要对订单进行任何修改或取消(全部或部分),必需直接通过道旅系统,而非直接与旅游产品供应商联系。由于修改而产生的费用,道旅系统将向客户重新收取。部分旅游产品一旦预订成功,无法做任何修改,由此造成的损失,由客户自行承担。在入住酒店/出行前或入住/出行期间,如果您有任何问题或疑问,请直接联络我们的客户服务人员。


特殊需求:如您有特殊需求(例如:有无障碍通道),您应联系客户服务或酒店/航空公司,确保该特殊需求可以得到满足。请注意所有的特殊要求都要视乎实际情况而定,道旅系统不能作出保证。

注意事项

1.我们所有赔偿只针对实际经济损失,且赔付金额不超过“有房保障”的赔偿标准;

2.赔付统一在离店后受理;所有凭证需在客人离店后1个月内提交,到期仍无提交则视为放弃保障权利。

3.以上所有赔付和协调方案,都是双方有事先沟通的情况下生效;

4.处理赔偿事务中,请保留相关凭证,我们需凭证,才能赔付。尤其是改订的账单+支付凭证;

5.条款中所述,“到店前”是指客户在订单入住日所预定酒店开始办理入住时间之前;“到店后”是指客户在订单入住日所预定酒店办理入住时间段之内。酒店办理入住时间以道旅平台显示为准;“距离入住日大于等于7天”、“距离入住日小于等于5天”均以自然日间间隔计算,不以24小时一天为计算标准。

6.条款中所述,“差价”是实际入住的订单价格与原订单价格对比所产生的差额;

7.当天房的预定日期与入住日期,按当地时间为准;

8.不予赔付的几种情况

a.客户遇到订单问题未第一时间与我们联系,自行安排行程的,视为您自动放弃了“有房保障”赔付的权利,将不予赔付,且客户所产生的一切费用概不负责;

b.我们向客户提供不低于原房型、原价格的、同间夜数的酒店房间(同一酒店或者附近酒店),且双方协商一致,客户办理入住的;

c.包括但不限于恶意购买行为的订单;

d.客户没有提供真实有效入住凭证(发票+水单),且与原订单入住城市、入住人、入住日期等不相同的;

e.团房拆单风险, 我们不接受团房分拆多个订单的操作方式,因为团房分拆导致酒店做出任何处理(包括向旅客在入住时索取附加费或旅客被临时安排另一酒店等等),我们恕不负责;

f.非代理商原因造成的订单无法入住,如酒店设置故障,遭遇不可抗力(如自然灾害、突发事件、政府征用等)等;

g.不遵守道旅全球酒店分销系统酒店分销政策(如禁止在携程、去哪儿、去啊、艺龙、美团等OTA平台售卖),我们有权利直接取消订单,扣除全部房款,不予赔付并保留按照酒店规定采取进一步措施的可能;

h. 我们已经核实并知会客户入住人为重复预定。

i.请于页面展示酒店最晚入住时间前办理入住,无规定最晚入住时间的,请于首晚22点前办理入住。如无法按规定时间入住,请提前告知,否则酒店有可能按照no show取消订单,我们将不作退款及赔偿。

七、 旅游建议 - 签证要求

我们提请您注意,去某些地方旅行存在较大的安全风险,请您在预订旅行前(尤其是去国外旅行时)查看政府或当地使领馆颁发的旅行禁令、警示、公告及建议。

道旅系统显示特定地点的酒店信息,但不代表建议去这些地方旅行或认为没有风险,道旅对去这些地方旅行造成的损害或损失不承担任何责任,道旅对您入住酒店/出行期间发生的意外亦不承担任何责任。强烈建议您查看将要去旅行的国家政府发布的相关旅行公告,并采取必要的预防措施,同时建议您购买个人旅行保险。

取得旅行必备的文件是您的责任,如果您没有携带必备的护照、签证或文件而造成损失,道旅不承担任何责任。建议您与相关国家的领使馆及/或签证部门进行核查。

请注意,一些国家对限制或禁止进口的物品有严格的法规规章。这些物品包括但不限于酒精、烟草、香水、药物、书籍、电影、光碟、成人娱乐材料、食品、植物、动物器官等。请您核实并遵守准据法规。

八、服务条款的修改

根据国家法律法规变化、运营需要或为提升服务质量的目的,道旅会在必要时对本协议及/或各类规则进行不时修改或更新,并将在道旅平台相应页面提前公告或通知。上述修改/或更新后的文本将在相关更新说明指定的日期开始生效实施,但道旅承诺,将在文本生效之日前至少七天进行公告或通知。

客户应当及时查阅并了解相关修改/或更新内容,如客户不同意相关修改/或变更,客户有权于变更事项确定的生效日前联系道旅平台反馈意见。如您的反馈意见得以采纳,道旅将酌情调整变更事项。如客户对已生效的修改/或变更内容仍不同意的,可停止使用道旅平台相关修改/或变更内容所涉及的产品/服务,此情形下,修改/变更内容对您不产生效力;若客户在上述修改/或变更内容实施后继续使用道旅平台所涉及的产品/服务的,将视为客户已同意各项修订/或变更内容。

九、服务变更、中断、终止

1.您完全理解并同意,本服务涉及到互联网及移动通讯等服务,可能会受到各个环节不稳定因素的影响。因此任何因不可抗力、计算机病毒或黑客攻击、系统不稳定、您所在位置、设备关机、GSM网络、互联网络、通信线路等其他道旅平台无法预测或控制的原因,造成服务中断、取消或终止的风险,由此给您带来的损失,在法律允许的范围内,道旅不承担赔偿责任。

2.道旅平台需要定期或不定期地对提供网络服务的平台或相关的设备进行检修或者维护,如因此类情况而造成网络服务(包括收费网络服务)在合理时间内的中断,道旅无需为此承担任何责任,但道旅平台应尽可能事先进行通知。

3.您完全理解并同意,除本服务协议另有规定外,鉴于网络服务的特殊性,道旅平台有可能变更、中断或终止部分或全部的网络服务。除了您已经通过道旅平台订购或申请的产品/服务并已完成支付并已获得确认订购或申请的情况之外,道旅无需为变更、中断或终止服务承担任何责任,但道旅应尽可能事先进行通知,并尽可能给您预留时间以便处理相关权益。

4.对于下述原因导致的合同履行障碍、履行瑕疵、履行延后或履行内容变更等情形,道旅并不承担相应的违约责任:

(1)因自然灾害、罢工、暴乱、战争、政府行为、司法行政命令、黑客攻击、电信部门技术管制、重大传染病疫情及其他突发公共卫生事件、国家税务及其他相关政策的变更等不可抗力因素;

(2)因电力供应故障、通讯网络故障等公共服务因素或第三方因素;

(3)在道旅已尽善意管理责任的情形下,因常规或紧急的设备与系统维护、设备与系统故障、网络信息与数据安全等因素。

十、客户行为规范

客户在使用道旅平台产品/服务时,必须遵守中华人民共和国相关法律法规的规定,客户承诺将不会利用道旅平台的产品/服务进行任何违法或不正当的活动,包括但不限于下列行为:

1.上载、展示、张贴、传播或以其它方式传送含有下列内容之一的信息:

(1)反对宪法所确定的基本原则的;

(2)危害国家安全,泄露国家秘密,颠覆国家政权,破坏国家统一的;

(3)损害国家荣誉和利益的;

(4)煽动民族仇恨、民族歧视、破坏民族团结的;

(5)破坏国家宗教政策,宣扬邪教和封建迷信的;

(6)散布谣言,扰乱社会秩序,破坏社会稳定的;

(7)散布淫秽、色情、赌博、暴力、凶杀、恐怖或者教唆犯罪的;

(8)侮辱或者诽谤他人,侵害他人合法权利的;

(9)含有虚假、有害、胁迫、侵害他人隐私、骚扰、侵害、中伤、粗俗、猥亵、或其它道德上令人反感的内容;

(10)可能引发未成年人模仿不安全行为或违反社会公德行为、诱导未成年人不良嗜好等的;

(11)含有中国法律、法规、规章、条例以及任何具有法律效力之规范所限制或禁止的其它内容的。

2.为任何非法目的而访问道旅平台或使用道旅产品/服务,或未经许可,利用道旅平台从事以下活动:

(1)未经允许,进入计算机信息网络或者非法获取、使用计算机信息网络资源的;

(2)未经允许,对计算机信息网络功能进行删除、修改或者增加的;

(3)未经允许,对进入计算机信息网络中存储、处理或者传输的数据和应用程序进行删除、修改或者增加的;

(4)故意制作、传播计算机病毒等破坏性程序的;其他危害计算机信息网络安全的行为;

(5)未经允许,将道旅平台上的任何数据作商业性利用,包括但不限于在未经道旅事先书面同意的情况下,自行、协助或授权任何第三方以网络爬中、复制、传播等任何方式获取、使用道旅平台上展示的资料;

(6)从事洗钱、窃取商业秘密、窃取个人信息、违规套现、假冒道旅发布任何虚假或诈骗信息等违法违规活动;

(7)使用任何装置、软件或例行程序等其他方式干预或试图干预道旅平台站的正常运作或正在道旅平台站上进行的任何交易、活动,或采取任何将导致不合理的庞大数据负载加诸道旅平台络设备的行动;

(8)违反诚实信用原则的不正当竞争行为,或恶意下订单或虚假交易等其他恶意扰乱道旅平台产品/服务交易秩序的行为;

(9)与网上交易无关的其他行为,例如发布广告信息(得到道旅书面许可的除外);

(10)发布任何侵犯道旅平台或他人合法权益、违反法律法规及其他规范性文件(包括但不限于《互联网视听节目服务管理规定》、《网络信息内容生态治理规定》等)及本协议的内容。

3.扰乱平台交易秩序行为,包括但不限于:

(1)超过真实生活消费需求购买服务/产品;

(2)以不正当方式达成交易或参与活动,如使用插件、外挂等工具;

(3)违反诚实信用原则的不正当竞争行为,如刷单炒信;

(4)恶意下单、恶意维权、虚假交易等。

上述行为的发生,将视为您对本协议的根本违约。在任何情况下,道旅平台一旦合理地认为您存在或可能存在上述行为的(包括根据技术规则通过检测验证等方式进行判断),可以在任何时候,不经事先通知删除您散布或传播的任何信息,并中止或终止向您提供道旅平台的产品/服务。您需对自己在访问道旅平台或使用道旅平台的产品/服务中的行为承担法律责任。您若在道旅平台散布或传播以上违反国家法律法规或公序良俗的信息,道旅平台的系统记录将有可能作为您违法犯罪的证据向有关部门提供。

十一、客户的信息与隐私权保护

1.尊重客户及用户个人信息及隐私权是道旅的一项基本政策。在您使用道旅平台的产品/服务的过程中,道旅将采用相关技术措施及其他安全措施来保护您的个人信息与隐私权。

2.道旅非常注重未成年人的个人信息与隐私权保护,因此:

(1)若您为未成年人,应在监护人监护、指导下阅读本协议,并且使用道旅的产品/服务已经得到监护人的同意;

(2)若您是未成年人的监护人,应指导其上网应该注意的安全问题。若您同意未成年人使用道旅平台的产品/服务,必须以您名义申请交易或办理消费(如涉及),并对未成年人使用道旅平台的产品/服务进行正确引导、监督。未成年人通过您的账户使用道旅平台的产品/服务,以及行使和履行本协议项下的权利和义务即视为已获得了您的认可。

十二、法律

1、知识产权

除非另有说明,我们在服务中所使用的各类软件、内容、信息和资料的知识产权(包括版权)均归深圳市道旅旅游科技股份有限公司、其旅行提供方或供应商所有。

深圳市道旅旅游科技股份有限公司独家保留对提供服务平台所涉的自主知识产权的所有权利。若没有我们的明确书面许可,您无权复制、抓取、创建(超/深度)链接、发布、推广、销售、整合、利用、组合或以其他方式使用任何内容或我们的知识产权。

2、免责条款

我们基于“可用”基础,将所有内容,包括软件、产品、服务、信息、文档及所含相关图表按其“原样”提供给您。道旅系统不会对网站的运营或网站上的信息、内容或材料做出任何明示或暗示的陈述或保证,且在准据法许可的最大范围内,放弃所有明示或暗示的陈述、条件和保证,包括但不限于默示条件、性能保证、满意的合理努力、信息内容、标题或第三方不侵犯权利。道旅系统不保证也不作出任何陈述表明网站将毫无差错且持续运营,或缺陷将会得到弥补或网站及/或其服务器将会没有病毒,及/或其他有害成分。道旅系统不会对网站内的任何材料(包括软件、产品、服务、信息、文本及相关图表内容)保证其适用性、实用性、准确性、可靠性、完整性或时效性。

对于服务器错误、误导或重新导入传输、网络连接失败、传输或接受预订中断或计算机病毒或其他技术缺陷(人为的或技术的)造成的故障,道旅系统不承担任何责任。道旅仅承担因其故意或重大过失而导致的订单实际赔款。

您负有对您在道旅系统的网站账号的全部管理责任,道旅不承担由于账号丢失或被盗等原因给您成的任何直接或间接损失。

我们在此提醒您,如您预订的是机票,您提供给我们的相关信息(包括但不限于乘机人姓名、出生日期、有效证件信息、有效联系方式等)应该清晰、明确、真实、完整,在航空公司根据您提供的信息出票后,我们将不承担因您提供不清晰、不明确、不真实或不完整信息而导致的损失或赔偿责任(包括但不限于被航空公司拒绝登记、因修正乘机人信息产生的费用等)。除此之外,您负有对交易的真实合法性的全部责任,我们有权拒绝任何针对航空公司票价、GDS系统等交易信息与系统设备的滥用。根据国际航空运输协会开账与结算计划(以下简称“BSP”)及航空报告公司(以下简称“ARC”)的运作流程,航空公司最长可以在出票后13个月内对违规销售行为(包括但不限于违规使用GDS获得非法座位、弃程、为获得更低价格故意拼接不实际乘坐的航班等)开具代理人贷项通知单(以下简称“ADM”),如上述违规销售行为是由您或您的账户项下的违规采购行为导致,我们有权对您采取相应措施,包括但不限于暂停、中断或终止您使用账户的权利。如果您或您的账户项下的违规采购行为给道旅和旅游产品供应商造成任何直接或间接损失,我们对您有完全追索权。

对于机票预订,除非特别说明,您成功预订的订单将自创建之时起在道旅网站内保留30分钟,您需在该30分钟内完成支付,否则我们有权取消该订单及预订。若您需要延长保留时间,须在上述30分钟内向我们提出,由我们对该订单进行保留(但我们不承诺该订单在延长保留期间内的有效性)。预订成功后由于航空公司舱位或票价变动等原因仍有可能导致价格变化, 实际需支付的价格以您实际支付时的价格为准。若航空公司票价发布信息存在错误,在航空公司发布正式书面通知前后4小时内,或航空公司在预订系统中取消该等运价下的订单后4小时内,我们有权取消您的订单(无论是否实际支付完毕)而不承担赔偿责任。

值得注意的是,我们提请您及时取消通过道旅网站以外的其他渠道的相同旅客、相同行程的预订,因为部分航空公司会根据您的重复预订行为取消所有预订,我们不承担由于您的重复预订行为导致的航空公司取消预订造成的任何直接或间接损失。

3、适用法律、管辖和争议解决

本服务条款及我们提供的服务受中国法律管辖并据其解释。任何与本条款与条件及我们的服务有关的争议应提交至深圳市道旅旅游科技股份有限公司所在地具有管辖权的人民法院管辖。

若本服务条款的任何项失效、不可执行或失去约束力,您仍须遵守本条款与条件的其他条款的规定,或至少应同意接受与失效、不可执行或失去约束力的条款具有相似规范目的的新条款。

十三、 其他

道旅系统并不以任何方式(直接或间接地、独立地或与任何部分有关联地)拥有、管理、运营或控制旅游产品供应商或其提供的旅游产品。通过道旅系统成功预订的顾客由道旅的供应商提供旅游产品或相关服务。

您同意道旅免于承担任何责任、免受任何损害或损失,如果因您的任何作为、不作为或疏忽导致道旅承担任何损失、费用和开支的,您应当对道旅承担赔偿责任。如果您为或代表第三方(如家庭成员或旅行伙伴)使用道旅系统,因使用不当产生不准确信息的责任将由您承担。 另外,您应告知第三方所有适用条款和条件。每个为或代表第三方使用本网站的客户,应同意道旅免于承担任何责任、损失、伤害、诉讼或申索(包括诉讼费)。

您应受当地法律法规的约束,在某些国家合法的事项在另外一个国家可能不合法,您应咨询适用限制。如果旅游产品供应商因合法或监管原因拒绝或终止为您提供服务,道旅对此不承担任何责任。

服务条款的各项条款之间具有独立的效力。如果某一条款不具有强制执行力或者无效,仍可以根据准据法最大限度发挥其效力,且该条款的效力不影响其他条款的效力和执行力。该规定应由与原条款目的相近的条款取代。

道旅可保留随时以任何理由自由决定更改、延缓、终止网站及/或其部分(包括网站提供的某项服务或产品),及/或您使用网站(部分)的权利。即使网站被终止,您仍然受服务条款规定的义务(包括您作出的保证)、免责声明及责任范围的约束。另外,如您或第三方对网站的访问权被终止,道旅对此不承担任何责任。道旅保留按其认为适当的方式修订或废除服务条款(或其一部分)的权利。

我们没有实施某项权利并不意味着我们放弃该项权利。您不可分配或转让基于服务协议享有的权利。
如您与道旅就双方的交易签署了协议或达成了约定,如上述协议或约定与服务条款冲突,以上述协议或约定为准。
